This course will examine how to litigate a complex environmental tort case, including investigation, gathering facts, formulating claims, seeking class certification, conducting discovery, motion practice and trial. Using case law and real life examples, this course will illuminate key phases of the environmental litigation process. Other topics to be addressed will be the management of scientific and expert evidence, medical causation, analysis of liability and damages, and other unique characteristics of environmental tort cases. The course will teach the practical and substantive issues that make environmental tort litigation interesting and rewarding, but also very challenging.
